They also realized that the public administration is often a threat to the rights of the individual. And so they created standardized procedures and independent institutions (e.g. administrative courts) to enable effective appeals.
But they also created strict hierarchies of laws so that any official, even a lowly one, will have a sense of when a formality is in danger of violating a fundamental right, so that they shy away from doing that.
Here the child's human right to a family life and its civil right as a citizen to be in the country are obviously being endangered or violated.
In Austria, a statute that created that possibility probably wouldn't even get to parliament because it would be flagged up as unconstitutional. If it was passed, the constitutional court would be onto it, and they're quick with crap like this, they would strike it down within a couple of months. >

But another variant. I bought a bike new in 1996. Then (with some modifications) I rode it and left it out in the weather so much that around 2010 it was worn out. In 2023, however, I found the same model and size, but only lightly used, on a seond-hand platform and bought it and modified it almost exactly the same way as I had done the original. For me it is "the blue bike" (which is what I called the old one). Although in the meantime I have acquired another bike that is blue, that is "the Mercian".
You can all make up your own mind about which bike is the same bike. But when I'm riding it, it is almost the same bike. If not a reincarnation, perhaps a reacciaionation.

@ChrisMayLA6@zirk.us What amazes me is the UK's lack of an effective system for complaints and appeals that is independent of the ministries being complained or appealed against. Something like this should immediately be out of the hands of the Home Office.
What is also gobsmackingly bad in this case is that apparently nobody is even disputing for a moment whether the child actually has UK citizenship. The UK is constantly making fun of continental countries' bureaucracy, but you should show me another European country where the substance of a case involving an infant citizen would be sacrificed on the altar of formalities like this.
