Mum takes her son to a doctor. "So what is happening?" asked the doctor. "My son is always walking on his toes, I'm worried what is that. He says he doesn't do that consciously." Doctor looks at kid. "I understand. Long term effects of such behavior can lead to achilles tendon tightness if not corrected now, when it happens it can only be corrected surgically." Doctor glances at a kid again "Do you like ballet maybe?" doctor asked. "Umm... I don't know what that is, doctor" "What about animals, do you like.. Cats? Wolves maybe?" "Oh, he watches those nature channels on TV constantly! It's an obsession of his, he has at least 30 figurines of those.. wolves on a shelf in his room, it's becoming a problem!" answered mum, with tint of frustration in her voice. Kid looks at the floor distraught "Hey, young man, a member of your pack tracked down a deer, what do you do?" Kid looks at the doctor excitedly as his head tilts to back and deafening "AWOOOOO" fills the entire room, likely disturbing anyone in the waiting hall in front of doctor's office. Mother red from embarrassment scolds the kid for his behavior, almost shaking him, telling him to never do this again. Doctor without a word opens one of the drawers, his hand looking for something as he pulls out a circular stamp. He takes the child health record and stamps it, a circle intertwined within a triangle appearing on a page. "Your cub is fine, madam. @robin It's unfortunate how age verification craze has captured even our closest allies. Locally in Poland, a long existing organization fighting for freedom and privacy in digital space came to be very empathetic to the idea of age verification, arguing that age verification on service provider's side IS the regulation of Big Tech we need to protect minors. It's truthfully disheartening to see something like this, considering the threat those regulations pose to freedom and privacy of all Internet users. I don't believe a lot of creatures in those organizations mean anything bad, but I think they underestimate the harm those regulations bring. All of us want Internet to be safer for children and ourselves. But this is not the way to achieve this.

@danslimmon As someone who has been dealing with spam in wiki environment I think this is a bad take. Automated spam detection is hard because we don't want to accidentally target legitimate users. And legitimate user activity sometimes may look like spam to a dumb machine code. I can only guess what you mean by a "legitimate marketing activity", however implication that it's easy to make automated spam detection system that would target all corporate advertising is silly. Context is always important and no automatic spam filter can judge it better than a creature can. I do agree that spammers are insanely stupid, that I did notice after years of working in the field.

Someone tried to advertise AI #Minecraft mod generating website on #MinecraftWiki which made me aware there is now an entire business model built around using Gen AI to create Minecraft mods. Yeah, lets advertise a tool for non-coders to generate programs from plain text prompt to be executed in their non-sandboxed (sic) Minecraft game. What could go wrong! This is besides how unethical this is.

Z gniewu, jako że widzę jak szkodliwe pomysły przechodzą przez instytucje tworzące prawa. Chcę o nich wiedzieć, aby móc oddać swój głos oraz krytykę tych legislacji.

Z ciekawości, przed tym, jak zacząłem prace nad narzędziem, wiedziałem jedynie, że konsultacje społeczne istnieją, ale niespecjalnie dużo więcej. Stworzenie tego narzędzia dało mi okazję zagłębić się trochę bardziej w proces prawotwórczy w Polsce.

Z chęci pomocy i nadziei na większe zaangażowanie społeczne. Mógłbym stworzyć takie narzędzie tylko dla siebie, byłoby łatwiej i szybciej. Uważam, że takie narzędzie może pomóc wszystkim we wzięciu udziału w demokratycznym procesie państwa, a być może zaangażować nawet poza same konsultacje społeczne.

Na próżno szukać RSSów na stronie Sejmu. Myślę, że większość osób, które otrzymują informację o legislacjach, dowiaduje się o nich z mediów, te informacje są często już skażone pewnego rodzaju opinią autora. Mój bot wrzuca surowe dane z API Sejmu i nic więcej (chociaż zastanawiam się nad postowaniem o obywatelskich inicjatywach w Unii Europejskiej również).

@benjamineskola I'm not an US citizen, I do not live in US and honestly I don't want anything to do with US. I resist age verification laws in ways I can in my country currently. I consider myself a FOSS developer and therefore part of the community and I want to express my displeasure with compliance to something that affects creatures globally. Those functions have real world consequences, and I believe FOSS community should have a serious discussion on how to abide to draconian legislation like this one.

@MisuseCase And the Overton window is shifting fast, a year ago they've said that they'd oppose age gating any other website than those hosting pornography (https://eupolicy.social/@panoptykon/114398322486562064) while today the biggest discourse they engage in on this topic is age gating social media :blobcatsad: EDIT: I've looked again at blog posts and videos and will be asking Panoptykon to clarify their position on age-verification, as to me they give some conflicting statements at times and I'd actually want to know if they have Internet user's back or not on this issue.

To cite the definition from the California bill itself: “Operating system provider” means a person or entity that develops, licenses, or controls the operating system software on a computer, mobile device, or any other general purpose computing device. Linux OSs are made up multiple parts made by multiple different parties, the bill does not have clear enough definition to distinguish who should be responsible with implementation of that bill in my opinion. This is rather clear with Microsoft and Apple, but not with Linux.

Panoptykon dla mnie wydawał się przeciwwagą dla jednego ekstremum gdzie czy to korporacje czy to sam rząd używają metod inwigilacji/ograniczenia wolności obywateli, i z jednej strony cały raport wydaje się mieć taki cel, jest w końcu negatywny w stosunku do Pegasusa, to jednak używane argumenty skręcają nie w przeciwwagę ekstremum ale gdzieś po środku. Z mojej perspektywy Panoptykon zaczyna dużo więcej skupiać się na szerokopojętym „bezpieczeństwie”, czy to dzieci, czy to obywateli. Bezpieczeństwo od lat jest używane jako wymówka do ograniczania wolności i prywatności obywateli, i zastanawiam się czy Panoptykonowe podejście rzeczywiście jest złotym środkiem, czy może jedynie dosłownie środkiem okna Overtona, pomagającym niektórym usprawiedliwić działania gdzieś pośrodku ekstremum a środkiem obu ekstremów. Szczerze nie wiem.

W skrócie tak jak ja zrozumiałem to co było w dyskusji:

  1. W Polsce aplikacją weryfikującą będzie tylko mObywatel (z informacji, jakie mamy na tę chwilę). Na warstwie europejskiej będzie jeszcze ta europejska aplikacja portfela.

  2. Kod mObywatela nie będzie w pełni pokazany, w dalszym ciągu jest mówione o częściowej publikacji kodu.

  3. Informacja o wieku będzie podpisywana cyfrowo po stronie serwera rządowego jako że "większość urządzeń nie wspiera jeszcze podpisywania lokalnie". Czyli fakt że ktoś pyta o podpis jest w dalszym ciągu wiadome dla rządu (co prawda nie wiem jaka ilość informacji jest widoczna przy takim zapytaniu, ale z tego co rozumiem będzie w tym informacja o żądaniu o wiek). Aczkolwiek twórcy przekonują iż informacje o tego typu zapytaniach nie będą przechowywane (natomiast ta informacja będzie widoczna w aplikacji, jako że ta loguje podobno każde użycie portfela).

Ze strony prywatności jak piszę na samym blogu, w mojej opinii niekoniecznie niweluje to wszystkie problemy w tym obszarze, ale teoretycznie jest to w miarę przyzwoite rozwiązanie. Natomiast ograniczam tą opinię tylko do sfery tematu prywatności i mojej mniej eksperckiej opinii.

Zastanawia mnie jeszcze kto będzie mógł być podmiotem pytającym o atrybuty osoby, i jeżeli są to jedynie jakieś wcześniej zweryfikowane podmioty, to w jaki sposób będą one weryfikowane bez uszczerbku na zero-proofie.

@avolha Niestety przereklamowują komunikator. Ten działa na protokole Matrix, gdzieś już widziałem jak chwalą mSzyfra pod względem ochrony metadanych - ale Matrix ma problemy z metadanymi z powodów architekturalnych, także no raczej nie. Nie wiem jak mają też osiągać zgodność z RODO, skoro sam protokół w dalszym ciągu ma z tym problem (https://github.com/matrix-org/matrix-spec/issues/342) Chyba że nie federują pomiędzy jednostkami administracji publicznej.

@panoptykon Pytanie, czy szczytny cel zapewnienia bezpieczeństwa dzieci, rzeczywiście uświęca tak bardzo krytykowany i problematyczny środek, jakim jest weryfikacja wieku, i czy ten środek, w ogóle ma sens.

Pozwolę sobie jeszcze przytoczyć parę moich pytań z e-maila, jakiego do was wysłałem na ten temat, a na którego nie otrzymałem odpowiedzi, ponieważ niektóre stanowiska Panoptykonu w dalszym ciągu nie są dla mnie zrozumiałe.

  1. Jak Panoptykon definiuje te treści, do których dostęp powinien być regulowany?

  2. Na jakim poziomie weryfikacja wieku powinna przebiegać? Czy powinna być ona przeprowadzana na poziomie dostępu do platform Internetowych (Facebook, Instagram, TikTok, YouTube etc.?) Na poziomie sklepów aplikacji? Na poziomie systemu operacyjnego? (dwa ostatnie rozwiązania są proponowane w USA, niektóre zostały zaakceptowane)

  3. Jakie podmioty w ocenie Panoptykonu powinny zostać ustawowo zobowiązane do weryfikacji wieku użytkowników?

  4. Czy Panoptykon posiada stanowisko do/jest świadome odkrytych powiązań Big Techu z lobbowaniem za takowymi rozwiązaniami?

  5. Czy Panoptykon posiada stanowisko do/jest świadome stanowisk naukowców oraz innych osób związanych z prawami człowieka odnośnie do takowych rozwiązań?

  6. W jaki sposób Panoptykon zamierza wpłynąć na instytucje tworzące prawo w celu zapewnienia prywatności internautów oraz zminimalizowanie ryzyk związanych z wprowadzanymi metodami weryfikacji wieku?

@panoptykon Panoptykon skupia się na problemie prywatności w relacji do obowiązku weryfikacji wieku, i bardzo dobrze, bo to ważny temat i główny powód, dla którego dowody wiedzy zerowej będą niesamowicie ważne w implementacji.

Ale co raz nie znajduję refleksji na temat:

  • wolności i dostępu osób młodych w świecie cyfrowym (weryfikacja wieku będzie tę wolność ograniczała),
  • efektu mrożącego na zasoby edukacji seksualnej czy te, powiązane z mniejszościami społecznymi (o czym wiele NGOsów chroniących prawa osób LGBT głośno mówi),
  • wpływu legislacji na pseudoanonimowość w Internecie (lekko się otarliście o ten temat w przeszłości),
  • wpływu na cenzurę treści,
  • problemy implementacyjne dla mniejszych organizacji czy operatorów stron internetowych,
  • wykluczenie społecznościowe.

Mam wrażenie, że spora część polskiego społeczeństwa zgodziłaby się na pomysł weryfikacji wieku w Internecie, gdyby otrzymała takie pytanie. Natomiast z chwilą, gdy osoba dowiedziała się o wyżej wymienionych kwestiach, mogłaby szybko zmienić zdanie, czy wprowadzenie takich legislacji jest dobrym pomysłem.

Mamy niską świadomość o miejscach cyfrowych, wiele osób myśli magicznie, że metody weryfikacji wieku będą efektywne i praktycznie nie mają przeciwwskazań. Dlatego uważam, że poruszanie tego tematu bez omówienia innych problemów z weryfikacją wieku jest błędem, który niestety Panoptykon (i nie tylko) popełnia.

Mówimy też o podniesieniu wieku wejścia na platformy cyfrowe, ale de-facto z mojego rozeznania, ten już wynosi 16 lat za sprawą Art. 8 RODO, Polska nie obniżała tego wieku do ustawowo dowolnego wieku 13 lat[1]. Dyskusja o wieku 15+ brzmi niczym próba dublowania ograniczeń, które już dzisiaj w teorii powinny być egzekwowane a nie są. Gdy trudziłem się wolontariatem dla jednej z większych amerykańskich stron internetowych w zakresie moderacyjnym, to zgłoszenia użytkowników z większości krajów EEA poniżej 16 roku życia były egzekwowane przez administrację (gdy dla amerykańskich osób, wiekiem granicznym było 13 wg. In gaming #wiki news this week: https://gta.wiki community which moved off Fandom in March this year, noticed that a paid Fandom contributor was plagiarizing content of that community and bringing it back on Fandom. When this was brought to Fandom's attention, they claimed that the structure between the wikis would be obviously similar and that's not surprising it looks very similar (despite of even a typo getting through with copying process). When the journalists started looking Fandom decided to do 180 and ceased their relationship with contributor who was on their payroll. It's my newfound mission to add books written by gay furry book writers to Polish bookreading portal's catalogue to spread awareness of my culture (and well, to track better what I want to read too). I really wish those books were more available though, furry literature is a niche and there is just so little of it available in Polish (and because of that, obtaining those books is more pricy/annoying in Poland too). I absolutely don't mind reading in English, and probably even prefer that, just wish they were more available where I live, since I do kinda prefer paper over e-books. #furry #books #lgbtq

@gim @avolha To Soatakowe zgłoszenie bezpieczeństwa więc podchodził bym z przymrożeniem oka jeżeli chodzi o praktyczne wykorzystanie dziury, natomiast faktem jest że wiele aktywnie rozwijanych klientów Matrixa (nheko, Neochat) w dalszym ciągu korzysta z tej samej biblioteki Olm, która nie jest przez nikogo utrzymywana od chyba roku czy dwóch i zakładane jest że ma dziury, co jest bardzo słabe.

@ShadowRZ @matrix Agreed, never said it's Matrix Foundation's direct responsibility, I said it's ecosystem issue. While foundation could in theory offer expertise and help in implementation of new API which would benefit entire ecosystem and is within foundation's interests and mandate, I don't believe small security team of MX has the resources to do so. It's unfortunate, however, how at least in case of nheko (my client of choice) I feel like this issue has been neglected and downplayed by the maintainers. Though it is all volunteer developed software so I can hardly expect anyone to spend their time on this.

Hot take as an alcohol abstinent, but I think if at any point you were a threat to safety of other creatures under influence of alcohol, I believe it would be ethical (assuming possible) to induce alcohol beverage allergy in your body (such allergies already exist AFAIK). Drinking alcohol is not necessary for existence, it's harmful in any amounts, and if you show at any point that you've lost control because of it, to me this could be seen as measured and balanced response to take your ability to intake such beverages for life. Counter arguments will probably run in direction of it being too big and lasting of an intervention in someone's life and body (disputable) and potential unintended consequences, especially with amount of available medicine with such induced allergy (unsure how likely that one is).
