Agi: Omicidio Custra non è prescritto, Ventura deve scontare la pena AGI - La Corte d'Assise d'Appello di Milano ha stabilito che Raffaele Ventura, ex componente delle Formazioni Comuniste Combattenti e che vive in Francia, dovrà scontare una pena residua di 14 anni di reclusione per l'omicidio del brigadiere Antonio Custra, avvenuto a Milano il 14 maggio 1977. I giudici hanno accolto la richiesta della procuratrice generale Francesca Nanni di revocare la prescrizione relativa a quel delitto, per il quale Ventura era stato condannato a 22 anni e 8 mesi di reclusione. La decisione sulla prescrizione della pena La pg ha portato avanti la tesi, e la Corte le ha dato ragione, che il trascorrere della prescrizione si bloccò nel 2017 quando Ventura venne sottoposto a un "arresto provvisorio" per sei ore da parte della polizia francese su mandato delle autorità italiane. Questo episodio ha bloccato la prescrizione della pena, che e' ripartita appunto dal 2017 ed è ancora attuale. Il ricorso annunciato dalla difesa "Fino alla Cassazione sarà libero di andare e venire dalla Francia - spiega il suo legale Davide Steccanella -. Andrò in Cassazione per farmi spiegare come sia possibile ritenere l'inizio dell'esecuzione della pena per l'omicidio Custra del 14 maggio 1977 una sosta di 3 ore in una stazione di polizia senza vedere un giudice, in forza, si legge, di un mandato di arresto europeo dove vengono indicate condanne per fatti commessi fino al 1976. Quindi un anno prima e senza alcun riferimento non solo a Custra ma neppure al reato di omicidio". La vicenda giudiziaria tra Italia e Francia La Suprema Corte aveva accolto il ricorso della procuratrice Nanni contro l'ordinanza che due anni fa aveva dato la possibilità a Ventura, che vive da decenni in Francia sulla base della cosiddetta "dottrina Mitterrand", di rientrare in Italia da libero, se volesse. Ventura era uno dei 10 ex terroristi che sarebbero dovuti tornare in Italia dalla Francia nel 2021, dopo un accordo politico tra i due Paesi, per scontare le pene, ma i giudici francesi bocciarono le richieste di estradizioni. Dalla Cassazione si era poi arrivati ai giudici della Corte d'Appello che oggi hanno revocato la prescrizione. E' improbabile comunque che, anche in caso della conferma in Cassazione della decisione dei giudici milanesi, la Francia dia l'ok all'estradizione del 76enne Ventura.
