Agi: Omicidio Custra non è prescritto, Ventura deve scontare la pena
AGI - La Corte d'Assise d'Appello di Milano ha stabilito che Raffaele Ventura, ex componente delle Formazioni Comuniste Combattenti e che vive in Francia, dovrà scontare una pena residua di 14 anni di reclusione per l'omicidio del brigadiere Antonio Custra, avvenuto a Milano il 14 maggio 1977.
I giudici hanno accolto la richiesta della procuratrice generale Francesca Nanni di revocare la prescrizione relativa a quel delitto, per il quale Ventura era stato condannato a 22 anni e 8 mesi di reclusione.
La decisione sulla prescrizione della pena
La pg ha portato avanti la tesi, e la Corte le ha dato ragione, che il trascorrere della prescrizione si bloccò nel 2017 quando Ventura venne sottoposto a un "arresto provvisorio" per sei ore da parte della polizia francese su mandato delle autorità italiane. Questo episodio ha bloccato la prescrizione della pena, che e' ripartita appunto dal 2017 ed è ancora attuale.
Il ricorso annunciato dalla difesa
"Fino alla Cassazione sarà libero di andare e venire dalla Francia - spiega il suo legale Davide Steccanella -. Andrò in Cassazione per farmi spiegare come sia possibile ritenere l'inizio dell'esecuzione della pena per l'omicidio Custra del 14 maggio 1977 una sosta di 3 ore in una stazione di polizia senza vedere un giudice, in forza, si legge, di un mandato di arresto europeo dove vengono indicate condanne per fatti commessi fino al 1976. Quindi un anno prima e senza alcun riferimento non solo a Custra ma neppure al reato di omicidio".
La vicenda giudiziaria tra Italia e Francia
La Suprema Corte aveva accolto il ricorso della procuratrice Nanni contro l'ordinanza che due anni fa aveva dato la possibilità a Ventura, che vive da decenni in Francia sulla base della cosiddetta "dottrina Mitterrand", di rientrare in Italia da libero, se volesse. Ventura era uno dei 10 ex terroristi che sarebbero dovuti tornare in Italia dalla Francia nel 2021, dopo un accordo politico tra i due Paesi, per scontare le pene, ma i giudici francesi bocciarono le richieste di estradizioni. Dalla Cassazione si era poi arrivati ai giudici della Corte d'Appello che oggi hanno revocato la prescrizione. E' improbabile comunque che, anche in caso della conferma in Cassazione della decisione dei giudici milanesi, la Francia dia l'ok all'estradizione del 76enne Ventura.

The Court of Appeal in Milan has ruled that Raffaele Ventura, a former member of the Combat Communist Formations and who lives in France, must serve a remaining prison sentence of 14 years for the murder of Brigadier Antonio Custra, which occurred in Milan on May 14, 1977.
The judges granted the request by Public Prosecutor Francesca Nanni to lift the prescription regarding that crime, for which Ventura had been sentenced to 22 years and 8 months imprisonment.

The prosecutor argued her case, and the court agreed, that the lapse of time in the prescription was blocked in 2017 when Ventura was subject to a six-hour “preliminary arrest” by French police at the request of Italian authorities. This episode halted the prescription of the sentence, which restarted from 2017 and remains current.

“Until the Court of Cassation, he will be free to come and go from France – explains his lawyer Davide Steccanella -. I will go to the Court of Cassation to explain how it is possible to consider the beginning of the execution of the sentence for the murder of Custra on May 14, 1977, as a three-hour stop at a police station without seeing a judge, based on, one reads, an arrest warrant issued in Europe where sentences are indicated for actions committed until 1976. Therefore, a year before and with no reference not only to Custra but even to the crime of murder.”
The judicial saga between Italy and France
The Supreme Court had upheld the prosecutor Nanni’s appeal against the order that two years ago gave Ventura, who has lived in France for decades based on the so-called “Mitterrand doctrine,” the possibility of returning to Italy freely if he wished. Ventura was one of the 10 former terrorists who were due to return to Italy from France in 2021, after a political agreement between the two countries, to serve their sentences, but French judges rejected the extradition requests. From the Court of Cassation, it led to the judges of the Court of Appeal who today lifted the prescription. It is nevertheless unlikely that, even in the event of confirmation by the Court of Cassation of the Milan court’s decision, France will give the go-ahead for the extradition of the 76-year-old Ventura.
