"The Commission’s Digital Omnibus in the iteration of the so-called ‘Data Omnibus’ proposes to rewrite Article 22, one of the GDPR’s strongest safeguards against significant decisions taken solely through automated processing.
Most strikingly, it would allow automated decision-making to be considered ‘necessary’ for a contract even when the same decision could be taken by a human.
That is not a minor technical adjustment. It risks turning a safeguard into an exception: if a company can say that automation is useful or efficient, the question becomes not whether a human could make the decision, but whether the company has a reason to automate it.
The timing is difficult to ignore, mind you. While courts and regulators are finally showing why these safeguards matter, Brussels is considering making automated decisions easier to justify in the name of ‘efficiency’.
What are we willing to give up in the name of – allegedly - making regulation simpler? If a safeguard is treated as a burden because it makes automated decision-making harder, we should at least ask whose burden we are reducing and who will carry the risk instead."

1/3 🚨 EU governments could be just days away from agreeing to a deal on the #DigitalOmnibus on Data that would weaken some of the basic protections people rely on under the #GDPR such as knowing who is using their data and why, being able to ask what data a company holds about them, and objecting to certain uses or expecting it to be kept secure.

Sehr lesenswerter Kommentar! Die geplanten Änderungen am #Informationsfreiheitsgesetz weisen (wenig überraschende) Parallelen zur geplanten Einschränkung des Auskunftsrechts nach der #DSGVO auf.
Beides wird gerne als Abbau von #Bürokratie verkauft - unterm Strich steht jedoch in Deutschland wie auch auf EU-Ebene ganz klar ein Abbau der #Demokratie.

Ein Cookie-Banner braucht nur, wer mehr Daten als nötig erheben will. Weil Google mit dem Datensammeln extrem reich geworden ist, wehren sich die Lobbyisten in Brüssel mächtig gegen die Pläne der EU, das Leben von uns einfacher zu machen: Eigentlich sollten wir im Browser einstellen können, ob wir von kommerziellen Datenhändlern aller Art getrackt werden wollen oder nicht. Das aber wäre das Ende des Cookie-Banners - und vermutlich des Geschäftsmodells von Google.

🇪🇺 What happened to the EU Commission's plans on getting rid of cookie banners? Well, according to the Council’s latest position paper, those have been scrapped. 🚮 This is likely to result in a great deal of hassle and frustration for European users, as well as billions of clicks per year. 🍪

Europejska Rada Ochrony Danych oraz Europejski Inspektor Ochrony Danych wydali wspólne stanowisko w sprawie #DigitalOmnibus - zbioru propozycji zmian w unijnych aktach prawnych, w szczególności #RODO.
Organy te wypowiedziały się krytycznie o propozycji zmiany statusu danych spseudonimizowanych jako danych osobowych. Jednocześnie oceniają jako krok we właściwym kierunku zmiany dotyczące naruszeń (podniesienie poziomu ryzyka, uzasadniającego zgłoszenie oraz wydłużenie czasu na zgłoszenie).
