Replying to on eupolicy.social
A core amendment from Greens, which limits the scanning to specific suspects, got a simple majority of 322 in favour, 255 against, 36 abstentions. Even though this was not sufficient for the required absolute majority, this sends a clear signal in view of the on-going negotiations on the long-term Regulation, where this is part of the Parliament's mandate. The Parliament wants to stick to this line, this became clear today. (3/X)

So the main fight is now on the limitations on the scanning in the long-term Regulation. The Parliament needs to stick to its very restrictve line to not allow general #chatcontrol, but only look into communications of specific suspects. Negotiations will resume after the summer recess in September. (9/X)

Also, two amendments that would exclude the error-prone scanning for unknown material and for solicitation of children ("grooming") got a clear simple majority: 345+/237-/18a and 346+/254-/3a. Edit: To be clear, they were *not* adopted, since they failed to get an absolute majority of 360 votes. (4/X)

If you want to understand the exact voting procedure today, see the voting list here: https://www.europarl.europa.eu/sedcms/votingList/C10-0178.pdf And here you can see who voted how (point 2): https://www.europarl.europa.eu/doceo/document/PV-10-2026-07-09-RCV_EN.html (10/X)

So where are we? Parliament amended the Council position from first reading in its second reading (because the encryption amendments were adopted). Now, Council can accept it, and then this is it. If Council does not approve the amendments within three months, we go to Conciliation Committee and 3rd reading. See Article 294 of the Treaty on the Functioning of the European Union, https://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:12008E294:en:HTML (7/X)

See all amendments here: https://www.europarl.europa.eu/plenary/en/infos-details.html?id=1689&type=priorityInfo The one on specific suspects is Greens 5, the one on excluding known material is Greens 4/Renew 31/PfE 26, part one. The one on excluding scanning for solicitation is Greens 4/Renew 31/PfE 26, part 2. (In case you wonder: Patriots copied the Greens' amendment from March, and identical texts are voted together. Greens and Renew did not table them together with Patriots.) (6/X)

I expect the Council to approve the encryption amendments, because this is language already agreed in the negotiations on the long-term Regulation. (8/X)

One detail on the adopted amendments on protecting encrypted communication: They are specifically worded to also exclude client-side scanning, which is scanning of content before the encryption takes place for the transmission: "... interpersonal communications to which end-to-end encryption is, has been or will be applied". Update: The EU Commission has accepted the European Parliament's 2nd reading amendments on the #chatcontrol 1.0 file - the ones protecting encrypted communication. So Council can now adopt it with qualified majority. https://home-affairs.ec.europa.eu/document/download/95bce1fc-cd35-40f3-a5f1-93d083192524_en?filename=CSA%20Interim%20Opinion%20on%20EP%20amendments.pdf (12/X)

https://www.arte.tv/de/videos/123951-000-A/gefaehrliche-apps-im-netz-der-datenhaendler/ Great investigation of @netzpolitik_feed@chaos.social and @br_data@ard.social on #databrokers
This should really trigger some blast from the authorities.
Edit: Now without Youtube, thanks to @leanderlindahl@social.folkdata.se for flagging it.

We are in the same room where the final negotiations on the #AIAct took place over 39 hours in December 2023. It might be haunted - still no agreement.

Yess! Regulation (EU) 2021/1232 on "a temporary derogation from certain provisions of Directive 2002/58/EC as regards the use of technologies by providers of number-independent interpersonal communications services for the processing of personal and other data for the purpose of combating online child sexual abuse" https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A02021R1232-20240515, also known as #chatcontrol 1.0, just lapsed. It is illegal again to scan the content of private communications without initial suspicion.

The extension of the temporary #chatcontrol 1.0 was rejected by the European Parliament today, bizarrely enough with votes by Greens, Left and EPP (for different reasons). First reading is closed, this was it. It will lapse on midnight of 3rd April. 😁

@HowTheyVoteEU The second plenary vote had already been scheduled, based on the assumption that a trilogue agreement on another extension of chatcontrol 1.0 would need to be approved. And even if there was no such agreement, taking items off an already agreed plenary agenda can only be done by unanimity of political groups, or a vote at the beginning of the session. Both was prevented by EPP.

RE: @tazgetroete@mastodon.social

"Tech-Unternehmer kaufen einen Nachrichtensender" kann ernsthaft noch eine positive Meldung sein in 2026. Wow. Mal sehen, mit welcher Halbwertszeit.
