It guarantees freedom of expression by prohibiting Congress from restricting the press or the rights of individuals to speak freely. It also guarantees the right of citizens to assemble peaceably and to petition their government.
Stagi said she was standing close to the officer and filming him outside the U.S. Immigration and Customs Enforcement facility in Durango, a college town popular for outdoor recreation, when he hit her hand hard, causing her to lose her cellphone. Stagi, a retired hypnotherapist, said she then reached for the officer’s shoulder to get his attention. After she said he put her in a chokehold, she said he threw her down an embankment next to the street. She said she still experiences pain in her arm doing normal everyday activities, like putting on her jacket.
Court documents allege that Rice committed third-degree assault by causing bodily injury to Stagi, but the documents don’t describe how she was injured or make mention of a chokehold. Rice also is charged with criminal mischief for allegedly damaging Stagi’s cellphone.
Stagi said Wednesday she was disappointed Rice was charged with less serious crimes. The assault charge, a misdemeanor, carries a maximum sentence of just under a year in jail. But she hopes the prosecution sends a message that immigration officers can’t tackle people indiscriminately and use excessive force.

A federal court in Rhode Island has been asked to investigate after immigration officials instructed a government lawyer to withhold information about an international arrest warrant for a detainee accused of murder. After a judge ordered his release, Homeland Security officials labeled her an “activist” who tried to “thwart” the president’s agenda.
District Judge Melissa R. DuBose, who was appointed by Joe Biden, ordered the release of a Dominican immigrant last month while he challenges his removal from the country. DHS then published a press release accusing her of knowingly releasing a man wanted for murder.
During a court hearing on Monday, Assistant U.S. Attorney Kevin Bolan admitted that Immigration and Customs Enforcement officials told him not to disclose the existence of a warrant for Bryan Rafael Gomez. The DHS statement is “simply not true,” Bolan said.

The episode marks the latest escalation of the Trump administration’s attacks against a judiciary it believes is insufficiently deferential to the president’s agenda, which has prompted an avalanche of lawsuits from immigrants alleging violations of their due process rights as the government moves quickly to arrest and deport tens of thousands of people from the country.
In last month’s press release, Acting Assistant DHS Secretary Lauren Bis called Judge DuBose an “activist judge” who “released this wanted murderer back into American communities.”
“This is yet another example of an activist judge trying to thwart President Trump’s mandate from the American people to remove criminal illegal aliens from our communities,” she said. “Under President Trump and Secretary Mullin, DHS will continue to fight for the removal of criminal illegal aliens who have no right to be in our country.”
In a court filing last week, Bolan said he was “informed” by ICE that he “could not disclose” the pending overseas charge and that “a legitimate law enforcement reason prevented disclosure.”

Newly disclosed internal records show guards used pepper spray, restraint tactics and physical takedowns on more than a thousand detainees, many of them men simply demanding food, medical attention or access to their belongings.
A Washington Post exclusive investigation based on confidential ICE ‘Daily Detainee Assault Reports’ found that during the first year of President Donald Trump’s second term, detention staff used force 780 times across 98 facilities. The number of detainees subjected to those actions climbed to 1,330, a 54 per cent increase on the previous year.

The Office of the Immigration Detention Ombudsman, an independent agency outside of the Department of Homeland Security, reviews complaints about civil rights abuses, excessive force and other allegations of misconduct involving Immigration and Customs Enforcement and Customs and Border Protection.
An internal email seen by HuffPost attributes the closure to a lack of funding in the Homeland Security appropriations bills that ended the partial government shutdown — even though the bill’s text does not require the office to close. The office is required by law.

The office’s public-facing website, which instructs families and attorneys how to file complaints, is offline. A website describing the office is online only in an archived capacity that contains “outdated information that may not reflect current policy or programs.”
The closure follows more than 780 instances of ICE officers and detention staff using physical force or chemical agents against immigrant detainees since Trump returned to the White House — a 37 percent surge from the previous year.

Lawsuits across the country allege brutal conditions inside ICE detention centers, which the agency says are designed to be “non-punitive” facilities. Yet many of those facilities rely on the same tools and tactics inside prisons and jails holding people with criminal records.
Lawsuits also alleged unsanitary cells and inhumane treatment, a lack of access to legal counsel, outbreaks of measles in at least two facilities, and the hospitalizations and alleged medical mistreatment of children inside a sprawling camp that is holding a growing number of immigrant families.

A document posted to an official government contracting website by ICE on November 12, described the situation as an “absolute emergency” that needed to be resolved “immediately” to “prevent any further medical complications or loss of life.”
According to the ICE Health Service Corps (IHSC), payments to third parties were supposed to resume on April 30, 2026. ICE has contracted with a private firm, Acentra Health, to process reimbursements.
But when April 30 arrived, payments to third party medical providers did not resume. Instead, Acentra quietly updated its website stating that “[c]laims payment services are estimated to begin during the second quarter of [sic] 2026 calendar year (April — June).”
For decades, routine processing of third party medical reimbursement were processed for ICE by the Department of Veterans Affairs (VA), through the VA Financial Service Center (VAFSC). This did not divert resources from the VA as it was compensated by ICE for this service. The arrangement was terminated with no notice after the VA’s role was criticized by right-wing activists.
In a statement, a VA spokesperson says the department is ensuring claims are being processed during the transition. “[The Department of Homeland Security] has signed a new contract to process these claims and is currently onboarding the vendor,” VA spokesperson Pete Kasperowicz told KFF Health News in February. “Meanwhile, VA is supporting this transition until May to ensure claims are processed appropriately.”
A source at the VA with direct knowledge told Popular Information that this is false. “No claims are being processed,” the VA source said. “We’ve done zero work to support [ICE] since they couldn’t pay us.” The source spoke on the condition of anonymity because they are not authorized to speak to the media.
Kasperowicz’s claims are also directly contradicted by the IHSC website, which stated in an April 24 update to providers, “[p]lease continue to hold all claim submissions while IHSC works to bring the new system online in the interim.” The IHSC website announced on October 3, 2025, “Do not mail or submit electronic claims to the VAFSC until further notice. All mail will be returned to sender.” All subsequent communications about the VA’s role repeated this guidance.
For more than seven months, third parties have not been able to be reimbursed for medical services provided to ICE. This has coincided with a massive spike in detainee deaths and medical crises.
